BALTIMORE — Here it is down on paper: CMS has released a new MLN Matters article (MM6934) titled "Durable Medical Equipment National Competitive Bidding Implementation — 10G: Paying for Oxygen Equipment when Grandfathered."

According to the article, oxygen claims for Medicare beneficiaries in the CBAs "will be denied for portable or stationary oxygen equipment that is acquired on or after the start date for the Round One Rebid, when submitted by a non-contract supplier, if the supplier did not furnish the portable or stationary oxygen equipment prior to the start of the National Competitive Bid Round One Rebid."

Be aware, the article notes, that after the bid program is implemented, a non-contract supplier who chose to be a grandfathered supplier for oxygen "should also furnish additional oxygen equipment when medically necessary" to beneficiaries in the CBA who are already receiving oxygen from the supplier.
