  • CMS Contracts Research Firm to Prep For DME Competitive Bidding

    Baltimore Last month, CMS announced it has awarded a contract to the North Carolina-based Research Triangle Institute (RTI) to help launch the massive DME competitive bidding program called for under the Medicare Modernization Act (MMA). According to MMA, competitive bidding is slated to begin in 2007 in the nation’s top 10 metropolitan statistical areas (MSAs) and expand to the top 80 MSAs in 2009, after which the program could be implemented nationwide. The contractor is to assist CMS in developing options and recommendations “on effective strategies and designs” for implementing the national program, and will consult with CMS in preparing for this new payment methodology for DME.   • Respiratory Drug Access at Risk

    The Medicare Modernization Act (MMA) mandated that respiratory providers no longer be reimbursed at a percentage of the average wholesale price (AWP) for respiratory medication. Instead, starting January 2005 Medicare will reimburse the drugs at the average sale price (ASP) plus 6 percent. While the MMA required the General Accounting Office (GAO) to determine whether current payment for inhalation therapies is adequate, the report will not be completed until late this year. As a result, we believe that there will not be adequate time for Congress to consider the GAO findings and take necessary actions to modify this provision before ASP reimbursement begins.   • NCART Wants HHS To Carve Out Rehab Products from NCB

    Washington The National Coalition for Assistive and Rehab Technology (NCART), a coalition formed in February to address issues specific to the rehab industry, says it will push for rehab products to be exempted from national competitive bidding. In a position paper released in April, the organization said high-tech rehab products qualify under a provision of the Medicare Modernization Act allowing the Health and Human Services Secretary to exempt certain products when competitive acquisition “is not likely to result in significant savings.” In addition, the paper points out the provision specifies that in implementing HHS’ competitive acquisition authority, “the secretary may consider the clinical efficiency and value of specific items within codes, including whether some items have a greater therapeutic advantage to individuals.” According to the…
